The Supreme Court in the U.S. state of Nebraska has dismissed charges against a retailer who was accused of illegally distributing CBD. Originally charged in December 2017 with felony drug distribution and conspiracy, the owners of DJ’s Vapes in the village of Herman had their case repeatedly dismissed in Nebraska’s lower courts based on lack of evidence their products exceeded the nationally mandated 0.3% THC for hemp-based products. David Bracht, an agriculture and renewable energy attorney in Nebraska, said efforts are underway in the state to define hemp as the source of only trace amounts of THC, therefore making CBD and other extracts legal products. In its recent ruling, the Supreme Court declined to provide guidance on how to prosecute future cases involving CBD.
